On April 28, 1998, defendant Clifton S. Burns, an enlisted member of the United States Navy, was charged with attempted larceny of government property of a value not exceeding $1000.00. The offense took place at the Navy Exchange (“NEX”) at the Naval Amphibious Base Little Creek in Norfolk, Virginia.
