'The object of this proceeding is to review the action of the district court in sustaining a general demurrer to a complaint filed by the plaintiff in error, and a judgment against him for costs, he having elected to stand on the complaint. The complaint alleged that the plaintiff had entered into a contract with the school district to erect a school-house for $5,785.00, setting out the contract; that the plaintiff erected the school-house, and thereafter on the 26th day of May, 1910, sent to the directors a statement of the amount due him, wherein he stated that the balance unpaid on the…
