Plaintiff in error brought this suit against the bank, the defendant in error, to recover an alleged balance of a deposit account, amounting to the sum of $50d, together with special damages alleged to have accrued to the plaintiff by reason of defendant’s refusal to honor its certain sight check, for $70, drawn in favor of S. H. Hastings & Oo., in payment of a car load of empty bottles.
