In an action pursuant to RPAPL article 15, the plaintiff appeals from an order and judgment (one paper) of the Supreme Court, Dutchess County (Jiudice, J.), entered September 22, 1988, which, inter alia, granted the cross motion of the defendants, Department of Transportation of the State of New York and the State of New York, for summary judgment.
