On August 5, 1977, 2 a seventeen year old psychiatric patient, while unsupervised in a shower at Metropolitan State Hospital, hanged himself with a bed sheet. He died the next day. Earl O’Neill, the decedent’s father and the administrator of his estate, brought this action in negligence against two staff psychiatrists and their unit supervisor 3 seeking damages for conscious pain and suffering by the decedent and also for his wrongful death.
