BOND, Chief Justice.
Appellant instituted this suit against ap-pellee, Claude Gossett, upon a note and for foreclosure of a chattel mortgage on a second-hand or used aeroplane and, pending the suit, caused the aeroplane to be seized by writ of sequestration. Soon thereafter, appellee replevied the aeroplane, by giving bond in the sum of $1,900, with himself as principal, and Joe Marino and G. R. Underwood, as sureties.
