DAVIDSON, Presiding Judge.
Appellant was convicted of murder in the second degree and given five years in the penitentiary as his punishment. The facts show that defendant and deceased had been neighbors and friends for over twenty years, living in the same neighborhood. The State’s ease is in substance:
