Appeal by the defendant, the Hudson River Telephone Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of. the clerk of the county of Orange on the 30th day of December, 1909, upon the verdict of a jury for §3,000, after a trial at the Orange County -Trial Term, and also from an order entered in said clerk’s office on the 10th day of January, 1910, denying the defendant’s motion for a new trial made upon the minutes.

Woodward, J.:
The plaintiff was a lineman in the employ of the defendant, and on the 30th day of July, 1908, was severely injured while in the *287performance of his duties. The defendant was engaged in erecting a new pole for its business purposes, and it became necessary for the plaintiff, under the direction of the foreman or superintendent of the defendant, to ascend a pole erected and maintained by the defendant in the immediate locality for the purpose of fastening a sling and tackle blocks.
