I think the learned justice at Trial Term was wrong in his decision in this case. He was commendably interested in the welfare of the twenty children, aged from six to twelve or thirteen years, inmates of the “ Moeller Boarding School ” recently established in Yonkers by Mr. Horowitz and Mrs. Lipstein, who it is claimed are denied the constitutional right to free education given them by the State Constitution (Art. 9, § 1).
