This case has twice before received the consideration *210of this- court. ■ On' the first trial of the cause, there was a verdict and judgment for the plaintiffs. This court reversed that judgment, and remanded the cause for another trial. The opinion of the court, on the first appeal, will be found in 10th Tex. Rep., page 57.
