MEMORANDUM

JOSEPH H. YOUNG, District Judge.

The Secretary of Labor filed this lawsuit under the Fair Labor Standards Act of 1938, as amended, 29 U.S.C. § 201, et seq., hereinafter referred to as the “Act.” The complaint charged defendants with violations of the overtime and record-keeping provisions of the Act. Plaintiff further alleged that defendant’s business activities constituted an enterprise within § 203(s)(l) of the Act, obligating them to comply with the provisions of the Act.

In response, the defendants moved to dismiss on grounds that their employees are not subject to the Act.…
