MEMORANDUM OF OPINION AND ORDER

WILLIAM J. O’NEILL, Bankruptcy Judge.

Defendant, Engineered Protection Systems (EPS), filed a motion for summary judgment on Trustee’s complaint for avoidance and recovery of a preferential transfer. The summary judgment request is based on certain exceptions to preference. There are, however, genuine issues of material fact regarding these exceptions and summary judgment is, therefore, inappropriate. See Bankr.R. 7056 as it incorporates Fed.R.Civ.P. 56.
