OPINION

ROBERT L. CARTER, District Judge.

The plaintiff in this case is a former member of the New York Police Department. In 1974 the Department initiated disciplinary proceedings against him, and a series of departmental hearings, negotiations and state court adjudications followed. The departmental proceedings terminated when the parties reached a compromise agreement which purported to be “a final settlement of all claims by both parties.” This compromise was incorporated in an order of New York State Supreme Court Justice Abraham J.
