On January 14, 2016, Key Constructors, Inc. (“Key Constructors” or “plaintiff’) sued Harnett County, Harnett County Department of Public Utilities (“HCDPU”), South Central Water & Sewer District of Harnett County, North Carolina (“SCWS”), and MBD Consulting Engineers, P.A. (“MBD”). See Compl. [D.E.l].1 The dispute concerns a construction contract to build collection lines for the Harnett County defendants. See id. ¶¶ 9-10.
