The County of Kane (County) filed complaints in the nature of equitable bills for discovery against the defendant landowners and thereafter filed a motion for “pre-pleading discovery.” It sought permission to enter the land of the defendants, Elmhurst National Bank, as trustee under Trust No. 3000, Frederick E. Haskins and Mary L. Haskins (the Owners) to conduct surveys, appraisals and subsoil tests preliminary to condemning the lands for highway construction purposes.
