Mercure, J.E Appeal from an order of the Supreme Court (Czajka, J.), entered July 28, 2003 in Ulster County, which, inter alia, granted certain defendants’ motion to dismiss the complaint.

This action involves a joint revocable trust established in 1994 by Harry Malasky (hereinafter decedent) and his wife, defendant Marion Malasky. Defendant Louis A. Klein succeeded decedent as a cotrustee with Malasky after decedent’s death in 1995.
