Triple Net Properties, LLC (“Triple Net”) sued Burruss Development & Construction, Inc., Donald H. Burruss, Full House Investments, LLC, John Doe I, and John Doe II (collectively, the “defendants”), asserting claims for breach of contract, fraud, punitive damages, attorney fees, and declaratory judgment. Triple Net also filed a notice of lis pendens with respect to the real property alleged to be the subject of the litigation. The defendants moved for summary judgment on all of Triple Net’s claims.
