A vendee of land instituted an action against the vendor, for rescission, cancellation, injunction, and recovery of a money judgment for a part of the purchase-price paid on the land, on the ground of mutual mistake between the parties as to the identity of the land sold. At the trial, after both sides had introduced evidence, the judge directed a verdict for the defendant.
