This case comes to ns on appeal from an order denying petition by the original defendant in the court below for leave to file bill of review.
In the original suit, Samuel A. Robinson filed his bill of complaint against Drawdy Investment Company to foreclose a mortgage on real estate given to secure a note for $10,000 with interest at 6%, executed April 26, 1920, and payable $1,000.00 on or before May 1, 1921, and $1,000.00 on May 1st of each succeeding year, including 1925, and a balance of $5,000.00 on May 1, 1926.
