Affirming as to Husbands, Cartwright, Fowler and Yancey; reversing as to Houser and Powell.

These six cases grew out of the same state of facts, and are heard together by agreement, although the questions involved are not the same in all the cases. The eases of Henry Houser and O. B. Powell against the appellees present identically the same questions and were heard together in the. court below, and the same is true of the two cases of J. W. Fowler and J. T.
