PIERCE, Judge.

This is an interlocutory appeal from an order granting motion to dismiss Count I of an amended complaint filed by appellant Marion R. Avery, as plaintiff below, and against the heirs of Flossie R. Blair, deceased, and the administrator bank of her estate, defendants below.

The sole question presented here for determination is the sufficiency of the amended Count I, hereinafter referred to as Count I, to state a cause of action, namely, whether the averments, if true, were sufficient to warrant an equity Court in decreeing specific performance of an oral contract *252between Flossie…
