In this land use case, petitioners seek review of a Land Use Board of Appeals (LUBA) order reversing a Deschutes County decision that had granted a conditional use permit to petitioners to establish a “private park” on their property, under ORS 215.283(2)(c), for the purpose of hosting weddings and similar events for a fee. Under ORS 215.283(2)(c), subject to county approval, “[p]rivate parks, playgrounds, hunting and fishing preserves and campgrounds” may be established as nonfarm uses on property zoned for exclusive farm use.
