Plaintiff Theodis Stokes brought this action under Title VII of the Civil Rights Acts of 1964, as amended, 42 U.S.C.A. §§ 2000e to 2000e-17, 1981a, and the fourteenth amendment to the United States Constitution as enforced by 42 U.S.C.A. § 1983, claiming that defendant City of Montgomery, Alabama discriminated against him because he is an African-American and retaliated against him because he had filed a previous discrimination lawsuit against the city.
