This appeal arises from an action for wrongful death brought by the estate of Margaret Rhea (“Rhea”) against multiple defendants after her car was struck by a fireman responding to a fire. The claims against all defendants were settled with the exception of the claims against Nor man Sapp (“Sapp”), the individual fireman who caused the accident. The trial court entered judgment in favor of Rhea, and Sapp brings two points on appeal.
