Plaintiff appeals by leave granted by this Court on February 23, 1982, the trial court’s November 23, 1981, order granting defendant Wayne County’s motion for summary judgment. Plaintiff filed his original complaint in the Wayne County Circuit Court on May 22, 1981, against the Wayne County Sheriff’s Department and Robert Russo. Plaintiff alleged that Russo, a Wayne County deputy sheriff, while off duty, was at the Village Place Restaurant in Southgate with plaintiff’s girlfriend on November 10, 1980, at about 3 a.m. When plaintiff saw the two together in the restaurant,…
