Kerrigan v. State
Supreme Court of South Carolina
1Opinion of the Court
Harwell, Justice:
Petitioner William Daniel Kerrigan pled guilty to grand larceny of an automobile. We granted petitioner’s writ of certiorari to review the denial of his application for post-convic tion relief (PCR). The issue is whether the PCR judge erred in denying petitioner’s claim that his trial counsel was ineffective for failing to inform petitioner that if he went to trial, he could have requested a charge on the lesser offense of use of a vehicle without permission, and might have been convicted on the lesser offense. We reverse and remand.
