Appeal from the Circuit Court of the United States for the Western District of Missouri. Suit by Berney Kennedy and others against George W. Custer and another. Decree for defendants, and plaintiffs appeal.

HOOK, Circuit Judge.

This was a suit by Berney Kennedy and Emma K. Hacker against Sallie B. Custer to establish that the title of Eva Richards Kennedy, deceased, to a lot in Springfield, Mo., was acquired and held by her in trust for them. Upon final hearing the Circuit Court dismissed the bill. The complainants appealed.

R. F. Kennedy, the father of complainants, was married three times. Mrs. Hacker was born of the first marriage, and Berney Kennedy of the second. The third wife, Eva Richards Kennedy, died childless, and the defendant Mrs. Custer is her sole heir. The second wife died seized…
