OPINION
JAMES, Justice.
This suit was brought under the Texas Wrongful Death Statute, Article 4675, Ver non’s Texas Civil Statutes, by Lucille Helen Anderson and Bernie F. Anderson, individually and as parents and next friends of Dion Anderson, Deceased, pursuant to 42 United States Code, Section 1983 to 1988 inclusive, for deprivation of the Deceased’s constitutional rights under the Constitutions of the United States and of the State of Texas, and for violation of Article 5115, Vernon’s Texas Civil Statutes.
