PLEASANTS, Chief Justice.

This suit was brought by appellee against the appellant to recover damages for personal injuries. The petition alleges, in substance, that the plaintiff, Forest Bean, a minor above fifteen years of -age, was injured upon one of the public streets of the city of Houston through the negligence of appellant’s servants in the operation of a train of cars on appellant’s road, which crosses said street.
