The defendant was convicted of the offense of misdemeanor, and he excepts to the overruling of his motion for1 new trial. The accusation was based upon an alleged violation of the act of '1903. It is alleged, that the defendant, after having contracted with one Peden, to perform services as a farm-hand from September 24, 1906, to December 25, 1906, for $10 per month, on the faith of said contract procured from said Peden the sum of $1, with intent not to perform such service. It is further alleged, that Peden was damaged in the sum of $1, because the defendant neither performed the service…
