This case was tried before his honor, the judge of the city court of Newton, without the intervention of a jury, a jury trial not being demanded. The court adjudged the defendant guilty, and, upon motion therefor, refused him a new trial. We think a new trial should have been granted, and, therefore, that the court erred in overruling the motion. It is unnecessary to consider all the assignments of error. Some of them are devoid of merit, and the discussion of others can serve no useful purpose, as it would b.ut recall well-recognized principles. We shall, therefore, only refer to the…
