Pending before this Court is a Report and Recommendation issued by the magistrate judge, in which the magistrate judge recommends the “Motion to Dismiss Plaintiffs Complaint for Damages; Breach of Contract; Breach of Implied Covenant of Good Faith; and Bad Faith Dealing With Prejudice Pursuant to Federal Rule of Civil Procedure 12(b)(6)” filed by defendant USAA Casualty Insurance Company (“USAA”) [Doc. 7] be granted in its entirety and that plaintiff Michael S.
