The proceedings in this workmen’s compensation case were complicated by an oversight of the court below and a consequent misunderstanding by the board, which were later cleared up by the court.
Anthony Soroka was employed by the defendant coal company at its West Shenandoah Colliery. He was killed on September 21, 1931, while riding in an empty mine car up an inclined plane in said mine, the empty cars being drawn up by the force or pull of loaded ears descending the plane.
