GLENN A. NORTON, Judge.

Quentin Yates appeals the judgment dismissing his Rule 24.035 motion without an evidentiary hearing. We affirm.

I. BACKGROUND

Yates was charged with one count of first-degree assault, one count of armed criminal action predicated on the assault and two counts of unlawful use of a weapon — the first for shooting a firearm from a motor vehicle under section 571.030.1(9) RSMo 2000 1 and the other for shooting a firearm into a dwelling house under section 571.030.1(3).
