This case is before the Court on cross-motions for summary judgment. Plaintiffs are American Medical International [hereinafter, “AMI”], thirty-seven of its wholly owned subsidiary hospital corporations, and one hospital organization which AMI manages. The defendant is the Secretary of Health, Education and Welfare, who is responsible for the administration of Title XVIII of the Medicare Act, 42 U.S.C. §§ 1395 et seq.
