The Secretary of the U.S. Department of Labor (“the Secretary”) brought this action against Scott Wallis (“Wallis”), Ronald Eriksen (“Eriksen”), USA Baby, Inc., USA Baby, Inc. 401(k> Plan, and USA Baby, Inc. Health Plan for violations of the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1001 et seq. (R. 1, Comply 1.)
