ELLIS, Judge.

The defendant in this suit obtained a default judgment in the District Court against the plaintiff herein and pursuant to said judgment had issued a writ of fieri facias which directed the sale of certain merchandise upon which was claimed a vendor’s lien and privilege in order to satisfy the money judgment obtained. While the advertisement for the sale of these articles was being made the present plaintiff instituted this suit.
