I. Introduction

On or about January' -27, 1997, Lorenzo Flores (“Flores” or “Petitioner”) filed a petition pro se, pursuant to 28 U.S.C. § 2254, for a writ of habeas corpus in the United States District Court, Southern District of New York (“Petition”). Flores had been convicted, following a jury trial, on January 31, 1989, in New York State Supreme Court, Bronx County, of Murder in the Second Degree (N.Y. Penal Law § 125.25[2]) and Criminal Possession of a Weapon in the Fourth Degree’(NY.'Penal Law § 265.01) and was sentenced to concurrent prison terms…
