I. INTRODUCTION
Plaintiff Alfred DiSabatino complains that the defendants violated various provisions of the Comprehensive Omnibus Budget Reconciliation Act (“COBRA”), specifically those codified at 29 U.S.C. §§ 1161-68, which amended the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1001, et seq. Presently before the Court are plaintiff’s motion for partial summary judgment, (Docket Item [“D.I.”] 25), and defendants’ motion for summary judgment. (D.I. 29.)
