E.P. Wheat brought this action, denominated by the parties as an action for money had and received, in the Circuit Court of Platte County, against Platte City Benefit Assessment Special Road District of Platte County and State Highway Commission of Missouri as defendants. Plaintiff asked judgment against defendants in the principal sum of $883.96 with interest thereon from January 5, 1922. A jury was waived and the cause submitted to the court upon an agreed statement of facts.
