This is an appeal by Rebecca A. Thomson (hereinafter “the Appellant”), from a final order of the Circuit Court of Kanawha County granting summary judgment to the Appellees, Erna McGinnis, Robert R. Vitello, and The Property Centre, Inc., in an action instituted by the Appellant alleging negligence and fraud in connection with her purchase of a home. The Appellant contends that genuine issues of material fact existed which should have precluded the lower court from granting summary judgment.
