MEMORANDUM DECISION and ORDER

PARKER, District Judge.

FACTS

This action for violations of the Sherman Act, 15 U.S.C. § 1 et seq,, civil rights, 42 U.S.C. § 1983, and state law is before this Court on defendants’ motions to dismiss pursuant to Rule 12(b) of the Federal Rules of Civil Procedure. Plaintiff Louis C. Rose, a New York resident, is a physician licensed to practice in the states of New'York, New Jersey and Florida.
