The fairness and conciseness with which the questions at issue have been presented on the briefs, and the frankness with which each side has conceded what is the result of reported decisions bearing upon the general subject-matter of the discussion, has greatly lightened the labor of the court, and has made it unnecessary to undertake any extended review o f those authorities.
