In an action, inter alia, to recover damages for the alleged breach of an insurance contract, the defendant insurance company appeals, as limited by its brief, from so much of an order of the Supreme Court, Richmond County (Sangiorgio, J.), dated December 2, 1985, which, upon reargument, adhered to a prior order of the same court, dated July 3, 1985, which denied its motion for summary judgment.

Ordered that the order is reversed insofar as appealed from, on the law and the facts, with costs, the motion is granted, and the complaint is dismissed.
