This bill is brought to restrain tbe defendants, who are the mayor and aldermen of tbe city of Rutland, from *147further prosecuting proceedings by which the city is seeking to condemn certain water rights owned by the plaintiff for the purpose of increasing its water supply. The cause was heard below on demurrer to the bill, and resulted in a decree for the plaintiff from which the defendants appeal.
