MEMORANDUM OPINION

M. BRUCE McCULLOUGH, Bankruptcy Judge.

On July 11, 1996, this Court ordered counsel for the debtor to show cause why the above captioned bankruptcy case should not be dismissed for lack of subject matter jurisdiction. This Court entered such order sua sponte because it was concerned that the voluntary petition commencing the case (a) had not been consented to by all 4 of the partnership debtor’s general partners as required by Rule 1004(a) of the Federal Rules of Bankruptcy Procedure (FRBP), and (b) had not been filed (ie., signed) by a general partner pursuant to either FRBP…
