At approximately 2:00 p.m. on September 29, 2009, Stephen Rousseau (“Rousseau”) and Michael Rosario (“Rosario”) (collectively “Defendants”) were transporting prisoners to various detention facilities in the State of Florida. One of the passengers was Tommy Lee Benton (“Benton”). It was a hot day, and the prisoners, including Benton, complained about the lack of ventilation in the stainless steel compartment where they were seated.
