ROBSON, District Judge.
The plaintiff has moved for summary judgment. This court is of the opinion the motion should be granted.
The defendant, an Illinois corporation, is licensed by the Small Business Administration (“S.B.A.”) pursuant to the Small Business Investment Act of 1958 (“Act”), 15 U.S.C. § 661 et seq. The Act provides financial assistance to help meet the initial capital requirements of newly-licensed investment companies and for expansion of their operations.
