MURPHY, Circuit Judge.
I. INTRODUCTION
Defendant Kevin C. Eaton was convicted in a jury trial for unlawfully possessing three unregistered explosive devices in violation of 26 U.S.C. § 5861(d). During the trial, the district court rejected Eaton’s assertion that the circumstances of his case were analogous to those in United States v. Dalton, 960 F.2d 121 (10th Cir.1992). The district court therefore denied Eaton’s motion for judgment of acquittal and, during the jury instruction conference, rejected his proposed instruction based on Dalton.
