On the night of November 1; 1960, Mrs. Gertrude H. Allen was a guest passenger in an automobile driven by the appellant Louise W. Hatchell. Mrs. Allen was. fatally injured in a collision between this automobile and one driven by one Tommy Lee Garner. This action for her wrongful death was brought by the plaintiff as administrator of Mrs. Allen’s estate, for the benefit of her five surviving children, against Mrs. Hatchell and Garner, alleging that the death of Mrs. Allen was proximately caused by the joint and concurrent negligence, recklessness, heedlessness, willfulness,…
